Chairman Agle called the July 1, 2004 Meeting
of the Eden Town Planning Board to order at 7:40 PM, stating that in the absence of a quorum, Andy Romanowski, Alternate Board Member, would serve as a voting
board member. Drew Reilly noted a few
spelling corrections to the minutes.
Agle requested a motion to approve the June 2004 minutes as amended, so
moved Bill Zittel, seconded by Jerry Schwab, carried all ayes.
NEW & UNFINISHED BUSINESS
Dick Minekime
– Two (2) major subdivisions.
Chairman
Agle stated that he received a copy of the Recreation Board’s recommendation to
the Town Board in regard to land in lieu of fees for the two subdivions, stating that the Rec
Board did prefer the greenspace. The Rec Board’s calcuation of land amounts to approximately 1 acre and
their rational was two-fold. (1)
Currently, there may be some encroachment off of the area (now owned by the
town); and (2) they also felt a need for additional off-street parking. Minekime stated
that he would like to discuss this request/recommendation with someone. Reilly explained that the final decision lies
in the hands of the Town Board. The Town
Board will make their decision based upon the recommendations of the Planning
and Recreations Boards as well as the best interest of the Town and
residents. The acre that the Rec Board has requested would not interfer
with the layout of the subdivisions. Minekime was directed to make an appointment to discuss his
concerns with the Rec and/or Town Boards. Agle stated that they might be willing to
discuss a compromise, i.e. greenspace from one
proposed subdivision and fees from the other proposed subdivision. Agle also stated that Minekime
can proceed with the preliminary plat because the proposed acre does not affect
the layout of the subdivision. Agle
stated that in the event that Mr. Minekime submits
his preliminary plat in 2 weeks, then Cathy could start the coordinated SEQR
review. Agle requested a motion to
instruct the secretary to begin the SEQR process once the preliminary plat is
received, Bill Zittel motioned, Andy Romanowski
seconded, carried all ayes.
CAMP MARY GLEN – Russ Gugino-Consultant,
Reverend Matt Mulheisen, Mike Hughes-Attorney Dave Stricklets – Architect. Chairman Agle stated that the Board did
receive a basic plan and a letter that requested permission to run a “daycamp” (9:00
am-4:00pm) for two weeks this summer. Agle stated that under the zoning code
(225-32B) summer camps require a “special use permit from the Town Board. Gugino submitted a plan to utilize the Camp for 2 weeks
during the Month of August 2004 for “DAY CAMP USE ONLY”, while the
organization continues to work on a full site-plan to submit for next years
camping season. Approximately 25
children would be brought to the camp via bus transportation, to spend the day. Mr. Gugino stated
that none of the buildings or facilities (such as the in-ground pool) would be
utilized. There is a stocked-pond on the
premises that would be utilized for fishing, paddle boating and canoeing, but
definitely NOT for swimming.
Portable bathroom and sink facilities would be set up on site. NO on-site food preparation would
occur. One meal per day would be brought
in to serve. The long-term goal is to
provide a summer camp for children who are victims of physical, emotional
and/or sexual abuse in Western NY. Camp Good Days and Special Times is our
example. A large tent will be erected on
site for recreational/shelter/eating area.
Agle followed up from the last meeting by asking what if any permanent
access arrangements have been made? Gugino stated that
they are still in negotiations with a resident on Keller
Road, as well as with St. Mary’s
Church. Currently Zydell’s
land gives easement access to the camp.
Agle stated that there are two access issues: (1) access for emergency vehicles (2) code requirement for road frontage
of 50’ minimum- 500’. Reilly was
researching the code to see if there is a “temporary permit”, because if the
Camp goes through the regular
“site-plan” approval process, it would take a minimum of 3 months
for approval, missing the entire camp season.
Reilly read a point-by-point list from Scott Henry regarding Campground
requirements (attached). Ed Krycia stated that a few years ago, the Town Board granted
permission for a Circus to perform in town.
Chairman Agle motioned that the Planning Board recommend
favorably for the Town Board to issue a “special event” temporary permit (if
such a permit exists either through the Town of Eden Code or the Town Board’s
authority under the State’s Enabling Legislation) for the Camp to operate for 2
weeks ONLY during the month of August with the following requirements:
1. NO OVERNIGHT STAYS (9:00am – 4:00pm time table suggested).
2. Portable bathroom and sink facilities are
utilized, and that the Health Department signs off on said usage.
3. NO USAGE of
any current buildings (they must be locked).
4. Proof of
adequate insurance, eliminating any liability to the Town of Eden.
5. Eden Fire and Rescue determine whether or
not the 15’ access road would be adequate during possible emergencies.
6. The Camp Mary Glen meets all Public
Health and Safety issues, AND with the understanding that the Camp continues to
work on the full site plan and that a Permanent camp CANNOT be established
until all of the requirements of the code have been satisfied.
Bill Zittel seconded, carried all
ayes.
Russ Gugino
added as a footnote that the cabin in which Father Baker slept and the pine
trees that he planted around the cabin are still in place, making this an
attraction to the camp. His biography that
was written by the Diocese actually depicts this area.
Mr. Hughes stated that currently
there is an outstanding building code issue regarding the “caretakers
house” not having a certificate of occupancy and that they would like to remedy
this problem. Reilly stated that they
must seek a c/o from the building inspector with some
relief from the Town Attorney, if relief applies. Reilly read from past minutes that Scott
Henry notes that the Camp has requested a temporary permit from the Town Board
in the past but were denied and never appealed the decision.

Post Meeting Notes: John Wittmeyer, and
Kathy Gier – St. Mary’s Church Council members
addressed the Planning Board stating that the Church does not intend to sell
any property to Camp Mary Glen at this time or in the future.
