Chairman, Mark Agle called the March 28, 2007 Planning Board meeting to order at
7:05 p.m. Minutes of the February 27, 2007 Planning Board Meeting were approved as
printed and distributed. Motion by Dennis Brawdy, seconded by Bill Zittel. Being no discussion, all “Ayes” motion
carried.
NEW & UNFINISHED BUSINESS:
Mark – The first order of
business on today’s agenda is the request from Schmitt Sales, Inc., seeking
permission to add diesel fuel to it’s other grades of
petroleum products currently offered for sale at Eden Shurfine. The original use for gasoline dispensing was
by Special Use Permit back in 1995.
Mr. Terry Mahon
– I represent Schmitt Sales, Inc., and we are working with Eden Shurfine as
well as several other of our smaller market/gas station locations. As indicated in my letter to the Town
Supervisor, we are looking to add diesel fuel to replace the “Supreme” grade,
which is no longer selling. We have
already made this switch at several of our other locations. Eden Shurfine would be just one of several
other small market/gas stations on our list.
Mark – What exactly is
involved? Would you be changing the
canopy? traffic patterns? I also understand you brought the original
Site Plan.
Mr. Mahon
– First off all, I worked on the original project back in 1995 and am therefore
thoroughly familiar with all of what is involved. We will not change the canopy in any
way. We will need to install a new 8,000
pound underground storage tank with would meet and comply with all NY State DEC
Regulations as well as all Federal EPA Regulations for underground storage
tanks. We would also like to change one
of our existing gasoline dispensers and put in a gasoline/diesel capability. What it is, if you may recall, Sunoco had a
special hose for its Ultra 93. What they
do is replace that hose dispenser with the diesel pump unit. Everything would look the same. There would be no other changes to anything
on the property. Traffic flow would
remain the same.
Mark - Based on the site plan and
canopy location, which pump would it be on.
(Some discussion and review of the Site Plan showing
pumps and canopy). It would be on
this island, closest to the underground storage tanks? (southerly
island)
Mr. Mahon – Yes. Okay, the reason we never put diesel in years
ago, was there was no real demand for it.
Since then, diesel fuel has changed it is now called (as of this year)
Ultra Low Sulfur Diesel. It’s less the
1,500 ppm of sulfur so the odor associated with diesel is no longer present. Plus the popularity of diesel pick-up trucks
and landscaping vehicles is huge. There
is no longer any demand for premium fuel and we are therefore looking for
another product.
Mark – If it is on this island
and large trucks came in looking for fuel would they have room to turn around?
Mr. Mahon - Well, I don’t really
anticipate any heavy truck traffic, we are not a truck
stop. I don’t see the big trucks using
that location unless they are very desperate.
I cannot put signs up saying no large trucks because they are allowed in
to make deliveries. Also the dispenser
is a standard 10 gallons per minute dispenser it is not a high flow diesel pump
like you would see at a truck stop. So
for a large truck to come in, he would really have to be desperate.
Mark – However, does your canopy has enough clearance if needed?
Mr. Mahon – Yes, its 14’ 6” that
is the current canopy requirement.
Mark – Does anyone have any
additional discussion? As far as this
board is concerned there are no changes with the building or any structure on
the site. We are merely making a
recommendation that the Town Board favorably consider the request.
Kevin – I have a question. What about the distribution of agricultural
diesel on a separate pump? Can the
farmers maybe be offered a discount? You
would probably have more tractors passing by there than big trucks. (Some varied discussion as to agricultural
fuel and/or farm equipment and the need for another source of fuel as there is
currently only one location in town for agricultural diesel).
Mr. Mahon
– Well we hadn’t thought of that. As you
are aware there is off-road kerosene at that location. We might look into a separate agricultural
diesel tank. I suppose that would be something else that we could consider and
would need to look into at some point in the future.
Kevin – That
was my only thought maybe to save our farmers some money and create a
little healthy competition with the only agricultural diesel suppliers around
town. Other than that I have no concerns. If the farmers can save 5 cents a gallon at
Shurfine well then I am sure they would go to Shurfine.
Dennis Brawdy – I make a motion
that we recommend to the Town Board to favorably consider allowing the proposed
upgrade to add diesel to the existing fuel provided at Eden Shurfine. Seconded by Bill Zittel. All “ayes” motion carried.
ANNOUNCEMENTS/REPORTS:
Dana – The video session, which
will partially fulfill the required training for Planning and Zoning
membership, will be scheduled sometime in May.
I think the flyer will be out in a week or so. I think it is May 8, 2007 at 7 p.m.
Mark – Okay.
Kevin – I have an application for
the open vacancy for the Planning Board alternate member. Do you want me to get it now?
Mark – Yes, just give it to Dawn
and she will set them up to come in for an interview. Perhaps, after the next meeting, depending on
what is on the agenda. Maybe for 7:30 or 8:00. Dawn, call and find
out if they are truly interested and then schedule them for an interview.
Bill Zittel – I make a motion to
adjourn. Dennis Brawdy – Seconded. All “Ayes” motion carried. Meeting adjourned at 7:15 p.m.

scheduled for April 24, 2007
at 7:00 p.m.

Based upon this Board’s review of
all information submitted and by the presentation made at our March 28, 2007 meeting by Mr. Terry
Mahon, a representative of Schmitt Sales, Inc., the Planning Board hereby makes
the following recommendation:
1. We recommend
that the Town Board favorably consider the request of Schmitt Sales, Inc., to
add diesel fuel to the existing fuels offered at Eden Shurfine. Schmitt Sales indicates that no alterations
would be made to the canopy or the building.
The only changes presented are the installation of a nozzle to an existing
fuel pump and a new underground fuel tank.
