REGULAR MEETING – EDEN TOWN BOARD

TOWN BOARD MEMBERS PRESENT:

            GLENN R. NELLIS                -           SUPERVISOR

            EDWARD C. KRYCIA, JR.   -           COUNCILMAN (Deputy Supervisor)

Call To Order:

 

            Supervisor Nellis called the Regular Meeting of the Eden Town Board to order at 7:40 P.M.

 

Pledge of Allegiance:

 

            Supervisor Nellis led the assembly in the Pledge of Allegiance to the flag followed by a moment of silence.

 

Budget Transfers:

 

            Supervisor Nellis stated that there were several year-end “Budget Transfers”.  They are on file in the Town Clerk’s office.

 

MOTION was made by Councilman Krycia to approve the Budget Transfers as stated by Supervisor Nellis; seconded by Councilwoman Pew; All “Ayes”; Opposed? – None; Abstain? – None; Motion carried.

            Supervisor Nellis stated that there were 3 “Budget Amendments”.  They are on file in the Town Clerk’s office.

 

MOTION was made by Councilman Vacco to approve the Budget Amendments as stated by Supervisor Nellis; seconded by Councilman Krycia; All – “Ayes”; Opposed? – None; Abstain? – None; Motion carried.

 

Encumbrances:

 

            Supervisor Nellis stated that there were several Encumbrances.  They are on file in the Town Clerk’s office.

 

MOTION was made by Councilman Vacco to approve the Encumbrances as stated by Supervisor Nellis; seconded by Councilman Krycia; All – “Ayes”; Opposed? – None; Abstain? – None; Motion carried.

 

Payables:

 

            Supervisor Nellis stated that there were several Payables.  They are on file in the Town Clerk’s office.

 

MOTION was made by Councilwoman Pew to approve the Payables as stated by Supervisor Nellis; seconded by Councilman Krycia; All – “Ayes”; Opposed? – None; Abstain? – None; Motion carried.

 

 

Audit of Bills:

 

Supervisor Nellis asked if there were any questions or additions on the “Audit of Bills” which are on file in the Town Clerk’s office.  Supervisor Nellis stated that there are three additions to the Highway Abstract.  They are on file in the Town Clerk’s office.

            Supervisor Nellis asked for a brief Execution Session following the meeting for personnel reasons.

 

 

New and Unfinished Business:

 

1.)   Resolution – Belmont Management Co.

     

Supervisor Nellis offered the following Resolution:

 

WHEREAS, Belmont Management Co., Inc., has brought proceedings pursuant to Article 7 of the Real Property Tax Law challenging the assessed valuation of properties owned by it and located at 2865 Welch Lane (SBL No. 223.19-1-27) and 2775 Welch Lane (SBL No. 223.19-1-28) for the 1999, 2000 and 2001 assessment rolls, and

 

WHEREAS,   as a result of pre-trial negotiations, the parties have agreed to settle these proceedings on terms which will result in prospective relief in the form of reduced assessments in the future with no liability for tax refund, and

 

WHEREAS,   these terms of settlement have been reviewed and recommended by the Board of Assessors and the Town Attorney,

 

NOW, THEREFORE the Town Board of the Town of Eden hereby authorizes the Town Attorney to execute the Settlement Agreement on behalf of the Town of Eden and to obtain Court Orders confirming the terms of the said Settlement Agreement.

 

Seconded by Councilwoman Pew; All – “Ayes”; Motion carried.

 

2.)   Erie County Personnel Office

 

Supervisor Nellis received correspondence from the Erie County Personnel

Office regarding the Lifeguard positions.  There are 12 Lifeguard positions approved by the Personnel Office but only 6 positions exist in the Town of Eden.  At this time 6 additional Part-time Lifeguard positions need to be created.

 

MOTION was made by Councilwoman Pew to create 6 additional Part-time Lifeguard positions; seconded by Councilman Krycia; All – “Ayes”; Opposed? – None; Abstain? – None; Motion carried. 

 

Supervisor’s Report:

           

            Supervisor Nellis stated that the Re-organizational Meeting is scheduled for Wednesday, January 2, 2002 at 7:00 P.M. beginning with the swearing-in of elected officials and the first Regular Meeting of 2002 will be held Wednesday, January 9, 2002 at 7:30 P.M.

            There were none.

            Supervisor Nellis adjourned the Regular Meeting of the Eden Town Board at 7:55 P.M.

 

Executive Session:

 

            Supervisor Nellis adjourned the Executive Session on the Eden Town Board at 8:30 P.M.
