Call To Order:
Supervisor
Nellis called the Work Session of the Eden Town Board to order at 7:30 P.M.
Supervisor Nellis then thanked Mary Lou Pew, Deputy Supervisor for
presiding over the Town Board Meeting on June 11, 2003.
Pledge of Allegiance:
Supervisor
Nellis led the assembly in the Pledge of Allegiance to the flag followed by a
moment of silence.
New and Unfinished Business:
1.)
Schedule a public hearing for the July 23rd
Town Board Meeting – Town of Eden Proposed Local Law No. 6-2003 – An amendment
to Town of Eden Zoning Local Law Section 225-39-I.
Supervisor Nellis stated that
after much discussion at the June 11,
2003
Town Board Meeting regarding Building Permit No. 33-2003 for
Town of Eden resident Patrick O’Connell, 2455 Shadagee Road, that the Town
Board would set a Public Hearing to amend the Town of Eden Zoning Local Law
Section 225-39-I.
MOTION was made by Councilwoman Pew to set the Public
Hearing to amend Town of Eden Zoning Local Law Section
225-29-I for July 23, 2003
@ 8:00 P.M.; seconded by Councilman
Walker; All “Ayes”; Opposed? – None; Abstain? – None: Motion carried.

Correspondence Re: Notification of
Application to the New York
State
Liquor Authority for a Restaurant Wine License for Allison Cardarelli
Supervisor Nellis stated that
correspondence had been received from
Patrick J. Kelleher, ABC Consulting Services regarding an
application to the New York State Liquor Authority for a Restaurant Wine
License for the premise located at 8571 Main Street,
Eden, NY (as agent
for a corporation to be formed).
Supervisor Nellis stated that this is informational in nature and is on
file in the Town Clerk’s office.
MOTION was made by Councilman Vacco to close the Work
Session Meeting of the Eden Town Board for public hearing; seconded by
Councilman Walker; All “Ayes”; Opposed? – None; Abstain? – None; Motion carried.

Nellis closed the Work Session of the Eden Town Board at 8:00 P.M.
MOTION was made by Councilman Vacco to open the
Public Hearing to consider Proposed Local Law No. 5-2003 which amends Section
225-29 of the Zoning Code of the Town of Eden
to adopt a new “Town of Eden Sign Regulation”;
seconded by Councilman Walker; All “Ayes”; Opposed? – None; Abstain? – None;
Motion carried.

Public Hearing
Proposed Local Law
No. 5-2003
To amend Section
225-29 of the Zoning Code of the Town of Eden
to adopt a new Town of Eden Sign Regulation
Supervisor
Nellis explained the purpose of the public hearing was to listen to any
concerns or questions that citizens have.
Supervisor
Nellis stated that he received an e-mail from Bill Trask, Town Attorney
indicating that no further changes were made to the document at hand.
Ed Krycia,
Chairman of the Economic Development Committee stated that he worked with Drew
Reilly, Town Engineer and Scott Henry, Building Inspector to amend the current
Sign Regulation and make it more user-friendly and to enact the goals of the
Master Plan. At the present time the
regulation is in the code, but spread throughout making it very difficult to
understand. The Committee used the Town
of Newstead as a model and applied
the existing code as framework.

Proposed Local Law:

Discussion
continued between the citizens and members of the Town Board. Members of the Town Board and residents
publicly thanked Ed Krycia and the Committee for all their efforts in changing
the Sign Regulation.
All persons desiring to be heard, having been heard, Supervisor
Nellis closed the Public Hearing at 8:18 P.M.
3.)
Formation of a Code Review Committee
Mary Lou Pew, Deputy Supervisor
stated that the Town Board is requesting the
formation of a Code Review
Committee to fine tune and define the code as it exists. The Committee would exist of representation
from the Town Board, other Town Committees and two (2) residents of the Town of
Eden.
Councilman
Walker stated that the code, as it exists is not user-friendly and newly
adopted Town laws need to be added.
MOTION was made by Councilwoman Pew to approve the
formation of the Code Review Committee; seconded by Councilman Walker; All
“Ayes”; Opposed? – None; Abstain? – None; Motion carried.
Mary Lou
Pew, Deputy Supervisor requested that the Town of Eden
advertise in the “Eden Pennysaver” for volunteers that would be interviewed for
the position.
MOTION was made by Councilwoman Pew to advertise for
volunteers for the Code Review Committee; seconded by Councilman Walker; All
“Ayes”; Opposed? – None; Abstain? – None; Motion carried.
Supervisor’s Report:
Supervisor
Nellis requested an “Executive Session” at the conclusion of this meeting for
contract and litigation.
Supervisor
Nellis stated that the sidewalk and pipe work at Shurfine is being completed at
this time.
